Defendant: Gianna Margiotta And Ryan Kelley

Prosecutor Ron O’Brien announced today that the Franklin County Grand Jury has returned an indictment on parents Gianna Rae Margiotta, age 20, and Ryan Patrick Kelley, age 20, for one count of Endangering Children (F-3). Around midnight on April 6th, 2013, the couple took their seven week old daughter to Nationwide Children’s Hospital because she was having seizures. While at the hospital, the staff admitted the baby due to other serious injuries discovered during her examination. Between April 4th and April 7th, 2013, it is alleged that the biological parents violated their duty of care in failing to seek prompt medical attention for their baby who had suffered multiple skull fractures. It is further alleged that once the parents finally did seek treatment for their daughter, they were not truthful with medical personnel, which worsened the serious physical harm suffered by the infant. “If found guilty of this charge, both parents face a potential three years incarceration”, O’Brien said. Arraignment for the couple will be set for September 11th, 2013, at 1:30 pm in courtroom 2B at 345 S. High Street.
