Defendant: Lindsey Burt

Prosecutor Ron O’Brien announced today that a former Upper Arlington local attorney, Lindsey T. Burt, age 33, has been indicted for one count (F-4) Theft, one count (F-4) Forgery, one count (F-3) Tampering with Records, and one count (F-3) Money Laundering, for a total of four counts. Burt was supposed to file paperwork making Mark Chapa the guardian of his son, after his son’s mother passed away.   It is alleged that Burt altered a probate court document making it appear that she had been awarded guardianship, and she then sent the document to OPERS in order to collect death benefits intended for the sole minor child. The theft of OPERS funds occurred for five years, between April 18, 2008 through April 19, 2013, and the total amount of OPERS funds collected by Burt was $67,183.03. Burt voluntarily relinquished her law license in 2011. O’Brien stated, “These offense are punishable by a maximum penalty of 9 years in prison”. Arraignment for Burt is set for September 11th, at 1:30 pm in courtroom 2B at 345 S. High Street.
