Guilty Plea In the Death of Tristan Foor

Defendant: Elias Malone

Today, Elias Malone, age 22, entered a guilty plea before Judge Colleen O’Donnell to a charge of Murder with a 3 year firearm specification. He was immediately sentenced to 15 years to life for Murder plus 3 years consecutive for the use of a firearm. The total sentence was 18 years to life. He will first become eligible for parole consideration in 18 years less accumulated jail credit of 454 days.

The basis for this charge relates to the following facts: On January 27, 2021, Tristan Foor, age 22, was invited to the home of Elias Malone and Sydney Freshour at 4902 Aspen Pine Blvd. Ms. Freshour had issued the invitation. After he entered the home, he was confronted by Mr. Malone. Mr. Malone then pulled a gun from his waistband and shot Mr. Foor once. Mr. Foor fell down the steps to the front door. Mr. Malone followed Mr. Foor down the steps and shot him multiple times in the head, chest, shoulder and back. He later left the scene.

Mr. Malone informed the police that he was the person who shot Mr. Foor. Mr. Malone’s gun was recovered, and he was taken into custody.

Sydney Freshour has been indicted for Murder, Agg. Robbery, Robbery, Kidnapping and Tampering with Evidence on April 22, 2022.
